ORDER

This Criminal Original Petition has been filed by the petitioner to further extend the time granted in Crl.M.P.No.8055 of 2015, dated 18.12.2015 on the file of the Principal Sessions Judge, Madurai to deposit the entire amount of Rs.11,49,000/- involved in Crime No.866 of 2015 on the file of the respondent police, before the learned Judicial Magistrate No.V, Madurai.

2.The petitioner is arrayed as accused No.3 in Crime No.866 of 2015 for the offences under Sections 120(b), 406, 420, 294(b), 323, 342 and 506(ii) of I.P.C.

The petitioner filed Crl.M.P.No.7155 of 2015 before the learned Principal Sessions Judge, Madurai seeking anticipatory bail and anticipatory bail was granted to him on 20.11.2015 on condition that the petitioner shall deposit a sum of Rs.11,49,000/- on or before 11.12.2015,failing which the anticipatory bail petition stands cancelled and further time of extension will not be considered.

3. Since the petitioner could not mobilise the said amount, he filed Crl.M.P.No.8055 of 2015 on the file of the Principal Sessions Judge, Madurai, seeking extension of time. That petition was ordered granting time till 18.12.2015. Thereafter also the petitioner could not mobilise the fund within the time granted by the Court below. Hence, he has come forward with this petition seeking further time to deposit the amount before the Court concerned.

4. The learned counsel appearing for the petitioner submitted that considering the plight of the petitioner, further ten days time may be given to deposit the amount.

5. Heard the submissions and perused the materials available on record.

6. Considering the above stated facts and circumstances, this Criminal Original Petition is allowed and the time for depositing the amount of Rs.11,49,000/- in Crime No.866 of 2015 before the learned Judicial Magistrate No.V, Madurai, is extended till 27.01.2016.
