PRAYER: Criminal Original Petition is filed under Section 439 (1)(B) r/w 528 of BNSS to modify the condition imposed by the learned Principal District and Sessions Judge, Trichirapalli in Crl.M.P.No.4580 of 2023, dated 20.09.2023 with regard to Condition No.1 on depositing a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of the case in crime number.

O RDER This Petition has been filed under Section 439 (1)(B) r/w 528 of BNSS to modify the condition imposed by the learned Principal District and Sessions Judge, Trichirapalli in Crl.M.P.No.4580 of 2023, dated 20.09.2023 with regard to Condition No.1 on depositing a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of the case in crime number.
2. Heard on both sides. This Court has perused the records.
3. The petitioner filed a petition in Crl.M.P.No.4580 of 2023 under Section 439 of the Code of Criminal Procedure, 1973, before the learned Principal District and Sessions Judge, Trichirapalli, seeking bail. The learned Judge allowed the petition and directed the petitioner to deposit a sum of Rs. 5,00,000/- (Rupees Five Lakhs only) towards the credit of the crime number. Aggrieved by this condition, the petitioner again filed Crl.M.P.No.6334 of 2023 before the learned Principal District and Sessions Judge, Trichirapalli, seeking to modify the condition imposed in Crl.M.P.No.4580 of 2023. However, the said petition was dismissed vide order dated 01.12.2023. Aggrieved over the same, once again, the petitioner filed Crl.M.P.No.5187 of 2024 before the learned Principal 2/4
District and Sessions Judge, Trichirappali seeking the very same relief. However, the said petition was also dismissed on 03.10.2024. In the meantime, the petitioner preferred Crl.O.P.(MD).No.21199 of 2024 before this Court. After hearing both sides, this Court vide order dated 05.12.2024 allowed the petition and modified the condition imposed by the learned Principal District and Sessions Judge, Trichirappali in Crl.M.P.No.4580 of 2023 dated 20.09.2023.
