O R D E R This petition has been filed seeking direction to the 2nd respondent not to harass the petitioner under the guise of enquiry on the basis of the petition preferred by the 3rd respondent.

Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that on the basis of the complaint given by the third respondent, enquiry was undertaken and thereafter, the matter is referred District Crime Branch for further action. On the basis of the above said transfer, summon was issued to the petitioner and she has also appeared before the District Crime Branch and informed that in respect of the very same subject matter, FIR in Crime No.308 of 2021 has been registered against the seven persons. He further submitted that the petitioner has also filed a suit in O.S.No.304 of 2022 pending before the I st Additional District Court, Madurai.
3. Enquiry is being undertaken by the Investigating Officer. Mere attending the enquiry cannot be construed as a harassment. 2/4
4. This Court does not find any reason to interfere into the enquiry undertaken by the District Crime Branch, Madurai. The petitioner is directed to cooperate the Investigating Officer to complete the process of investigation. During the course of enquiry, if any trouble arises, the petitioner can workout her remedy through the appropriate proceedings. With the above directions, this Criminal Original Petition is disposed of.
