PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, calling for the entire records, connected with the detention order of the second respondent in Cr.M.P.No.5/Goonda/2023 dated 05.05.2023 and quash the same and direct the respondents to produce the body or person of the detenu by name, Santhosh @ Jeyaraman, son of Alagurajan, aged about 23 years, now detained as "Goonda" at Madurai Central Prison before this Court and set him at liberty forthwith. The learned counsel appearing for petitioner submitted that the wife of the petitioner has already approached this Court by filing HCP(MD)No. 1329 of 2023 and the detention order has also been quashed by order dated 19.02.2024. Therefore, the learned counsel seeks permission of this Court to withdraw this petition, since the prayer sought for in this petition has become infructuous. He has also made an endorsement to that effect.
2. In view of the above submission and the endorsement made by the learned counsel appearing for the petitioner, this Habeas Corpus Petition is dismissed as withdrawn.
