ORDER

The learned Counsel for the Petitioner submitted that the Petitioner is arrayed as A2 in Crime No.123 of 2021 and the Petitioner had filed this petition seeking to quash the F.I.R in Crime No.123 of 2021 on the file of the Respondent Police.

2.The learned Counsel further submitted that already in Crl.O.P. (MD)No.20592 of 2023, A4 in this case had settled the dispute with the de-facto Complainant and the F.I.R in Crime No.123 of 2021 was quashed against him based on the compromise.

3.The learned Government Advocate (Criminal side) had filed a status report. As per the status report, at the earlier instance, the case against the co-accused had been quashed.

4.The learned Judicial Magistrate No.II, Sivakasi, is directed not to return the money to the Police or to the accused in this case until otherwise this case is established through proper mode regarding the motive for taking the money. This case is involved distribution of money to the voters during the time of Election. Therefore, if there were no claimants, the learned Judicial Magistrate No.II, Sivakasi, shall pass appropriate orders forfeiting 2/4

the money to the State.

5.In the light of the status report filed by the Respondent Police, the F.I.R in Crime No.123 of 2021 pending on the file of the first Respondent is quashed.

6.With the above said direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed. 08.03.2024 NCC : Yes / No Index : Yes / No Internet : Yes / No jbr To 1.The Inspector of Police, Sivakasi East Police Station, Virudhunagar District.
