O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first and second respondents to conduct a survey and fix the boundaries of the petitioner's land comprised in Survey No. 918/02, measuring an extent of 12 cents, situated at Arasoor Village, Sathankulam Taluk, Thoothukudi District, based on the petitioner's application dated 03.09.2024.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries. Page No. 2 of 5

The learned Government Advocate appearing for the first and second respondents would submit that the patta in respect of the subject property does not stand in the name of the petitioner and that however, after conducting an enquiry and on consideration of the claims of the parties, the first respondent would take appropriate steps to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Court directs the first respondent to consider the petitioner's online application dated 03.09.2024 and conduct an enquiry. Only thereafter, the first respondent respondent shall survey and demarcate the petitioner's land, after considering the claims of all parties including the third respondent and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. It is needless to state that before conducting the survey, notice shall be issued to the adjacent landowners, the third respondent and other Page No. 3 of 5

interested parties, if any and that if required, police protection may also be sought.

6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
