O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the third respondent to conduct a proper enquiry and pass appropriate orders for cancellation of Patta No.727 standing in the name of the fifth respondent in respect of the property in Survey No. 52/119, measuring an extent of 0.5 cent, situated at Seethapatti, Kattupudur, Thotiyam Taluk, Tiruchirappalli District and consequently directing the fourth respondent to issue a joint patta in the names of the petitioner and the other legal heirs of the deceased Chellappan @ Chellappa Kavundar within a time frame to be stipulated by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to Page No. 2 of 6
the fifth respondent, as no adverse orders are proposed to be passed against her.
3. The grievance of the petitioner is that the petitioner's father, late Chellappan @ Chellappa Kavundar, owned and enjoyed the subject property, which is stated to be ancestral in nature. As per the 'A' Register, an extent of 0.5 cent in Survey No.52/119 stood in the name of the petitioner's father. One Suresh owns the remaining extent in Survey No. 52/119 and also owns land measuring 0.21⁄2 cents in Survey No.52/118. On 12.02.2020, the said Suresh executed a sale deed in respect of the properties belonging to him in Survey Nos.52/118 and 52/119. Thereafter, on the same day, he executed a gift deed in favour of his wife, the fifth respondent herein, in respect of an extent of 0.5 cent in Survey No.52/119, vide Document No.227/2020, which, according to the petitioner, belongs to the petitioner and the other legal heirs of the petitioner's father. Subsequently, on 05.05.2022, the fifth respondent executed a sale deed in respect of the said extent in Survey No.52/119, vide Document No. 522/2022.

4. The petitioner submitted a representation dated 27.11.2023 to the second respondent seeking cancellation of the patta by taking into consideration the 'A' Register entry. By proceedings dated 27.12.2023, the second respondent directed the third respondent to take appropriate action on the petitioner's representation. However, no action has been taken so far. Hence, the petitioner has been constrained to file the present Writ Petition.
5. The learned Government Advocate appearing for the first to fourth respondents, on instructions, submitted that the petitioner's representation would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.

Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 27.11.2023 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent shall afford a reasonable opportunity of hearing to Page No. 4 of 6
the petitioner, the fifth respondent and all other interested parties before passing orders. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. No costs.
