PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the fourth respondent to conduct a fair inquiry and issue patta in favor of the petitioner based on the order passed by the third respondent in his proceedings in Moo.Mu.A1-248-2015 dated 16.10.2015 and by considering the judgment and decree dated 03.09.2012 passed in S.A.No. 343 of 1996 by this Hon'ble Court.

This writ petition has been filed seeking issuance of a writ of mandamus, directing the fourth respondent to conduct a fair inquiry and issue patta in favor of the petitioner based on the order passed by the third respondent in his proceedings in Moo.Mu.A1-248-2015 dated 16.10.2015 and by considering the judgment and decree dated 03.09.2012 passed in S.A.No. 343 of 1996 by this Court.

3.When the matter was taken up for hearing, learned Government Advocate, appearing on behalf of respondents 1 to 4, submits that since the inquiry is pending before the second respondent, the same will be conducted and concluded within a period of eight weeks from the date of receipt of a copy of this order.

4.In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent/District Revenue Officer to conduct and conclude the inquiry, after providing sufficient opportunity of hearing to the petitioner, respondents 5 to 7 and all other persons interested in the subject property and to pass appropriate orders on merits and in accordance with the law within a period of eight weeks from the date of receipt of a copy of this order.
