Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the third respondent to conduct proper enquiry and pass appropriate order to cancel the Patta Nos. 1298 and 811 in favour of the sixth respondent, in Survey No.707/1, 708/1 and 709 situated at Manmangalam Taluk, Koyampalli Village, Karur District and consequently directing the fourth respondent to issue joint patta in the name of the petitioners and other legal heirs of the deceased Maruthan @ Maruthasaamban by considering the petitioner's and other legal heirs' representation dated 26.12.2025 within the time stipulated by this Court.

O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the third respondent to conduct a proper enquiry and pass appropriate orders cancelling Patta Nos. 1298 and 811 standing in the name of the sixth respondent in respect of Survey Nos. 707/1, 708/1 and 709/1 situated at Koyampalli Village, Manmangalam Taluk, Karur District and consequently directing the fourth respondent to issue a joint patta in the names of the petitioners and the other legal heirs of the Page No. 2 of 7
deceased Maruthan @ Maruthasaamban, by considering the representation dated 26.12.2025 submitted by the petitioners and the other legal heirs, within a time frame stipulated by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fifth and sixth respondents, as no adverse orders are proposed to be passed against them.
3. The grievance of the petitioners is that the fifth respondent is the daughter of one late Subramani through his first wife, whereas the petitioners are the children of the said Subramani through his second wife. The fifth respondent, by suppressing the existence of the other legal heirs, fraudulently obtained a legal heir certificate exclusively in her name. Based on the said certificate, she sold the subject lands belonging to the petitioners' father to the sixth respondent and the pattas were also mutated in favour of the purchaser.
4. Therefore, the petitioners and the other legal heirs submitted a representation dated 24.07.2025 to the first to fourth respondents seeking Page No. 3 of 7
cancellation of the wrongly issued legal heir certificate. The second respondent, after conducting an enquiry, directed the fourth respondent to rescind and revoke the legal heir certificate issued in the name of the fifth respondent.
5. Thereafter, the petitioners and the other legal heirs submitted a representation dated 23.10.2025 seeking cancellation of the pattas. The third respondent directed the fourth respondent to conduct an enquiry and submit a report. However, no action has been taken.
6. Subsequently, a legal heir certificate was issued in the names of the petitioners and the other legal heirs. The petitioners and the other legal heirs again submitted a representation dated 26.12.2025 requesting necessary action for change of patta. The third respondent further directed the fourth respondent to take appropriate action in this regard. However, till date, no action has been taken. Therefore, the petitioners have been constrained to file the present Writ Petition.
7. The learned Special Government Pleader appearing for the first to fourth respondents, on instructions, would submit that the petitioners' Page No. 4 of 7
representation would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.

Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioners' representation dated 26.12.2025 and pass appropriate orders, after concluding the enquiry already initiated, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The third respondent shall afford a reasonable opportunity of hearing to the petitioners, the private respondents and all other interested parties before passing orders. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. No costs.
