Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, forbearing the respondents 1 to 3 from interfering with the petitioner's land bearing Survey No.136/39 situated in Kallipattu Village, Tiruppathur Taluk, Sivagangai District in the guise of conducting Peace Commiittee Meetting between the Respondents 4 and 5.

ORDER

According to the petitioner, the petitioner is in possession of enjoyment of Natham Poromboke land in Survey No.136/39, situated in Kallipattu Village, Tiruppathur Taluk, Sivagangai District more than 65 years. Now, the respondents 4 and 5 are taking steps to conduct Pongal Festival in his land and on 08.12.2017, the fourth respondent has given a representation to the second respondent in that regard. Based on the said representation, the Tahsildar / second respondent proposed to https://hcservices.ecourts.gov.in/hcservices/

conduct a Peace Committee meeting on 15.12.2017 without issuing notice to the petitioner. Therefore, the petitioner gave a representation to the Tahsildar to consider his claim, but no order has been passed. Hence, the present Writ Petition has been filed.

2.Considering the fact that the petitioner claimed to be in possession of the land, and also contended that be is also an interested person in respect of the land, the Tahsildar, Tirupathur is directed to consider the petitioner's representation, while conducting the Peace Committee meeting and pass orders on merits and in accordance with law. 3.With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
