Prayer in Crl.MP(MD).No.3537 of 2023:- This Criminal Miscellaneous Petition is filed under section 482 Cr.P.C to relax the condition imposed by this Hon`ble Court in Crl.A.(MD)No.6 of 2023 dated 06.01.2023 Prayer in Crl.A(MD).No.6 of 2023:- This Criminal Appeal is filed under section 14A(2) of the Scheduled Castes and the Scheduled Tribes(Prevention of Atrocities ) Act, and amended act of 2015 to set aside the order of IIIrd Additional District and Sessions Judge(PCR) Court, Madurai made in Cr.M.P.No.3383 of 2022 dated 27/12/2022 and allow this appeal by enlarging the appellants on bail in connection with crime no.52 of 2022 on the file of the second respondent.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.D.S.Haroon Rasheed , Advocate for 1/3
the Petitioner and of Mr.R.Suresh Kumar, Government Advocate (Criminal Side) on behalf of the respondents, this Court made the following order:
This petition has been filed to relax the condition imposed on the petitioner in Crl.A.(MD)No.6 of 2023 dated 03.01.2023.
2. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly.
3. The learned Government Advocate (Crl.side) submitted investigation has been completed and Final Report filed before the PCR Court, Madurai and the same was taken cognizance in S.C. No.9 of 2023 and the next hearing date is 07.03.2023 for appearance of the accused. Further, that the petitioner has been complying with the condition regularly.
4. Let the petitioner/accused appear before the concerned trial Court on that date.
5. Considering the nature of offence, the condition imposed by this court in Crl.A.(MD)No.6 of 2023 is fully relaxed and the petitioner shall appear before the concerned Court on receipt of summons. In the result,this petition is allowed.
