PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, to direct the respondents to reinstate the petitioner in to the society service by considering the petitioner's past service from 1993 and working without salary from 2003 to 2012 for the society and by taking in to account of the good and smooth functioning of the third respondent society and based on the petitioner's representation dated 11.09.2017.

The writ petitioner was appointed as a clerk in the third respondent Co-operative Society in the year 1993. Up to 2003, he was getting regular salary and discharging his duty. https://hcservices.ecourts.gov.in/hcservices/
2.The third respondent Co-operative Society appeared to have fallen into bad times in the year 2003. Thereafter, the writ petitioner claims to have worked without getting any salary upto the year 2007. From the year 2007, there was no work to do also. In the year 2012, the society passed a resolution for deputing the writ petitioner to another society. The writ petitioner, however, did not comply with the said deputation order. Now, he gave a representation dated 11.09.2017 for rejoining the third respondent society.
3.The learned counsel appearing for the petitioner submits that the third respondent society is presently under the management of the duly elected Board of Directors. The third respondent Board is directed consider the petitioner's representation dated 11.09.2017 for reinstatement by taking into account the past service from the year 1993. The third respondent shall pass orders on merits and in accordance with law on or before 28.02.2018.
