PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS forbearing the respondent and their men, agents from collecting current consumption charges, demand charges and any arrears from the petitioner until the Respondent makes payment of the outstanding dues of Rs.28,89,108/- (for the year of 2024-2025) payable to the Petitioner or give adjustment in the current consumption charges payable by the Petitioner till the entire amount is adjusted. ORDER
The present writ petition has been filed forbearing the respondents from collecting current consumption charges, demand charges and any arrears from the writ petitioner until the respondents adjust the excess amount paid by the writ petitioner's Company.
2. Heard the learned Counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents. 2/5
3. The respondents are directed to adjust the excess amount, if any, payable to the writ petitioner in lieu of the wind energy generated by the petitioner's Company. After adjusting the same, if any due is there from the petitioner's Company, the same shall be demanded from them.
4. In view of the above said facts, this writ petition stands disposed of with a direction to the respondents to adjust the amount payable to the writ petitioner in the next 6(six) bills. No costs. Consequently, connected writ miscellaneous petition is also closed.
