Prayer: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent to transfer the investigation in Crime No.25 of 2020 from the file of the second respondent, to some other investigating agency. ORDER

This petition is filed seeking for a direction to the first respondent to transfer the investigation in Crime No.25 of 2020 from the file of the second respondent, to some other investigating agency.

2.Mr.S.Chandrasekar, learned Additional Public Prosecutor, on instructions, would contend that there are eight accused in Crime No.25 of 2020 of All Women Police Station, Musiri, for the offences punishable under Sections 498 A, 294 (b), 323 and 506 (i) of the Indian Penal Code, Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002 and Section 4 of Dowry Prohibition Act, 1961, and that the case is referred to the Social Welfare Officer and he is enquiring into the allegations made against the accused. According to him, the investigation is going on the right path and therefore, there is no necessity for transferring the investigation to some other investigating agency. 3.The learned counsel for the petitioner contended that though First Information Report in Crime No.25 of 2020 was registered on https://hcservices.ecourts.gov.in/hcservices/ 1/2

However, his contention that though the petitioner sought for a larger relief of transferring the investigation from the file of the second respondent to some other investigating agency, it would be sufficient that if the investigation of the second respondent is monitored by the jurisdictional Deputy Superintendent of Police. 4.Recording the submissions of the learned counsel of the petitioner, the Deputy Superintendent of Police, Musiri, is directed to monitor the investigation in Crime No.25 of 2020 done by the second respondent.

5.With the above observation, the present Criminal Original Petition is dismissed.
