Petition filed U/S 482 OF Cr.PC, to modify the condition No.(i) imposed on the petitioner by this Honourable Court in Crl.R.C.(MD).No.829 of 2021 dt 13.12.2021. ORDER:- This Misc. Petition coming on for orders on this day and upon perusing the earlier order of this Court dated 13/12/2021 made in CRL RC(MD).829 of 2021 and perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.Herold Singh Advocate for the Petitioner and of Mr. Thanga Aravindan, Government Advocate for the respondent(s), this Court made the following order:
This Criminal Miscellaneous Petition has been filed praying to modify the condition No.(i) imposed on the petitioner by this Court in Crl.R.C(MD)No.829 of 2021, dated 13.12.2021. 2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.The only grievance of the petitioner is that the First condition imposed by the this Court is onerous. 4.Heard the learned Government Advocate (Crl.Side). 1/3
5.Considering the facts and circumstances of the case and also considering grievance expressed by the learned Counsel for the petitioner, this Court is inclined to modify the condition No.(i) imposed in Crl.R.C.(MD)No.829 of 2021, vide order, dated 13.12.2021 as follows:
The First condition alone is modified to the effect that the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.43 of 2021 on the file of the learned Principal Sessions Judge, Kanyakumari District at Nagercoil along with a bond for Rs.5,00,000/-(Rupees Five Lakh only) with two sureties for a like sum and on further condition that the RC Book is to be deposited before the Court within a period of two weeks from the date of return of the vehicle.
