PRAYER: This Criminal Original Petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), to direct the respondents 1 and 2 to provide police protection to the life and limb of the petitioner and her family members from the respondents 3 to 5 on the basis of the petitioner's complaint dated 05.02.2025. This petition is filed by the petitioner to direct the respondents 1 and 2 to provide police protection to the life and limb of the petitioner and her family members based on his complaint dated 05.02.2025. 2.According to the petitioner, there is a dispute between the petitioner and the private respondents in respect of the property, thereby the petitioner lodged a complaint before the second respondent police. Based on which, a case has been registered in Crime No.56 of 2025 for the offence under Sections 296(b), 115(2), 118, 351(3) of BNS and Section 4 of Women Harassment Act, as against the private respondents and the same is pending. Again, on 04.02.2025, the private respondents entered the petitioner's house and demanded to give commission or otherwise, they threatened to kill him. Therefore, the petitioner lodged a complaint on 05.02.2025 and the same has not been considered so far. Hence, the present petition is filed.
3.The learned Government Advocate appearing for the respondent police would submit that the respondent police will conduct an enquiry based on the complaint given by the petitioner and act in accordance with Page No. 2 of 4
law. However, the respondent police will complete the enquiry within a period of one week.
4.Considering the limited scope of the prayer of the petitioner in this petition, this Court, without issuing notice to the private respondents, is inclined to dispose of the Criminal Original Petition. 5.Since the representation of the petitioner is under consideration by the second respondent, this Court directs the second respondent to dispose of the petitioner's complaint dated 05.02.2025 in accordance with law, within a period of one week from the date of receipt of a copy of this order.
6.With the above direction and observation, this Criminal Original Petition is disposed of.
