RESPONDENTS / RESPONDENTS/ PETITIONERS Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to Grant AD-INTERIM STAY of operation of the impugned order dated 31.05.2017 in M.C No. 6/2016 on the file of the Chief Judicial Magistrate Court, Theni pending disposal of the above Criminal Revision Petition.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.J.SULTHAN BASHA, Advocate for M/S.AJMAL ASSOCIATES, for the petitioner and of Mr.M.KALIRAJ, Advocate on behalf of the Respondents, while admitting the CRL RC., the court made the following order:- Both the counsel for the petitioner and the respondent are present.
2. The learned counsel for the petitioner filed a memo stating that a sum of Rs.1,20,000/- was deposited in compliance of the order passed by this Court dated 23.08.2017 in Crl.R.C.(MD).No.676 of 2017. He would further state that he has no objection to withdraw the said amount by the respondent herein.
3. In view of the no objection made by the learned counsel appearing for the petitioner, the respondent is permitted to withdraw the said amount from the concerned Court on filing proper application. Further the petitioner shall continue to deposit 50% of monthly maintenance as granted by the trial Court, on or before 10th day of every English Calendar month, till the disposal of the Criminal Revision Case. The respondent is also directed to withdraw https://hcservices.ecourts.gov.in/hcservices/
the amount as and when required on filing proper application before the trial Court.
4. With the above observation, the petition is disposed of and the interim order already granted by this Court is made absolute.
