PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus forbearing the respondents herein from initiating any action to recover the payment of incentive increment paid to the petitioner for having qualified M.Phil Degree granting by Vinayaka Missions University, Salem in the year of June 2008 and consequently direct the respondents herein to continue to pay the incentive increment to the petitioner based on the petitioner's representation dated 21.11.2022.

ORDER

The instant writ petition has been filed by a P.G.Assistant (Botany) working in a Government Higher School seeking a mandamus forbearing the respondents herein from initiating any action to recover the payment of incentive increment already granted to the writ petitioner for having qualified M.Phil Degree granting by Vinayaka Missions University, Salem.

2.A perusal of the typed set of papers indicate that the Headmaster of the School has already issued an adverse order to the writ petitioner on 14.11.2022 seeking to recover the incentive increments. Without challenging the said order, the present writ petition has been filed.

3.Considering the above said facts, this writ petition is disposed of with liberty to the writ petitioner to challenge the order of the fourth respondent herein dated 14.11.2022, if he is so advised. No costs. Consequently, connected miscellaneous petition is closed.
