(Order of the Court was made by T.S.SIVAGNANAM, J) Heard Mr.R.Murali, learned counsel appearing for the petitioner, Mr.Saravannan, learned counsel appearing for the first respondent and Mr.D.Muruganantham, learned Additional Government Pleader appearing for the second respondent.
2.The petitioner has filed the writ petition, to direct the first respondent to consider the petitioner for appointment based on the permanent community Certificate issued by the second respondent as Hindu Kattunayakan Scheduled Tribe to the post of Junior Assistant.

3.The apprehension of the petitioner was that the respondent Board, while considering the case of the petitioner for appointment to the post of Junior Assistant in the respondent Board will not consider him under the SC/ST Category.
4.The learned Additional Government Pleader appearing for the second respondent submitted that the petitioner was considered under SC/ST category. However, one other candidate Mr.M.Sivaji, has scored higher marks, viz., 55.75 marks, who is a SC/ST candidate, and he has been selected and the petitioner, who has secured 49.0 marks in the SC/ST category, has been kept in waiting list. Therefore, no further orders are required to be passed in the writ petition. Accordingly, the writ petition is disposed of. No Costs.
