ORDER

The petitioner seeks issuance of a Writ of Mandamus to direct the respondent to register a Sale Deed for the property to an extent of 1386 sq.ft and house situated in Survey No.269/10 at Thetthupatti Village, Dindigul West Taluk, Dindigul District, by accepting the certified copy of the Sale Deed vide Document No.46 of 1997 dated 28.01.1997.

2. The petitioner claims that he is the owner of the property situated in S.Nos.269/1C and 269/2D at Thetthupatti Village, Dindigul West Taluk, Dindigul District. He is in indigent circumstances and needs to generate funds for his medical expenses. Hence, he proposed to sell the property. When he approached the respondent, he was informed that the original of the sale deed dated 28.01.1997 has to be produced, otherwise, he would not register the same. Hence, the writ petition.

Additional Government Pleader states that the apprehension of the petitioner is unfounded. He further states that the document presented by the writ petitioner will be received and registered and the respondent will not insist upon the production of the original.

4. The statement made by Mr.R.Sureshkumar is recorded as an undertaking given by the respondent to this Court. As the respondent is not going to insist upon the production of the original, the apprehension of the petitioner is misplaced. Suffice it to dispose of this writ petition by recording the statement of Mr.R.Sureshkumar.
