ORDER

Heard both sides.

2.The petitioner presented the petition mentioned sale deed for registration on 15.12.2023. The grievance of the petitioner is that the registering authority neither entertained the document for registration nor issued any refusal check slip. The petitioner thereafter submitted a representation dated 05.01.2024. Since he did not illicit any response, the present writ petition came to be filed.

3.When the matter was taken up for hearing, the learned Government Advocate submitted that there was discrepancy in the survey number and that is why the document was not received for registration. That may be so, but then the stand of the registering authority must be set out in writing. The respondent cannot orally decline to register a 2/4

document. The document can very well be presented. If any document can be presented, the authority is obliged to issue the refusal check slip if the document is not in order.

4.The petitioner is permitted to re-present the document. The second respondent shall adopt one of the course of action as mentioned above. This writ petition is disposed of accordingly. There shall be no order as to costs.
