PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to provide Patta to the members of the petitioner's Association in respect of the Survey No.234/2 situated at Vembar Village, Vilathikulam Taluk, Tuticorin District, by considering the petitioner's representation dated 21.01.2023 within the time stipulated by this Court.

ORDER

An association has filed this writ petition for consideration of the representation dated 21.01.2023 to provide pattas to the members thereof. 2.Learned Counsel for the petitioner submits that there are 18 families of members of the association who have resided in the lands bearing S.No.234/2 for more than 20 years. It is also stated that these persons possess identity documents such as Aadhar card, Ration card and Votor ID showing the said address, but that they have not obtained electricity connection and water connection on account of not having patta.

3.Learned Special Government Pleader accepts notice on behalf of all the respondents. He submits that it would be necessary to reclassify the lands before considering the request for grant of patta. He also submits that such request should be considered by the first respondent. If a reasonable time is fixed, he stated that the first respondent would consider and dispose of the request. 4.In view of these submissions, without making any observations on the merits, the first respondent is directed to consider the request of the petitioner 2/4

for reclassification followed by grant of patta and dispose of the same within three months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner. While considering such request, the relevant CRD notification would be taken into account since the property appears to be closed. No costs.
