O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the second respondent in No.356/Tha.ku.2/2026 dated 02.02.2026 and direct the respondents to grant parole/emergency leave for 15 days to the petitioner's husband Ravindran, (43 years) S/o.Subburaj, C.P.No.6270, PID No.53453.
2. The husband of the petitioner is a convict in Spl.S.C.No.267 of 2019 on the file of the Sessions Court, Madurai and sentenced to undergo life imprisonment, which was challenged before this Court. While do the petitioner's mother-in law died on 26.01.2026 due to ill health, for which the convict was granted emergency leave for one day to do the funeral of his mother. Thereafter the petitioner submitted representation and sought for emergency leave for the 16th day death ceremony which is scheduled to the conducted on 10.02.2026. However it was rejected on the ground that the convict so far involved in 11 previous cases in which he was convicted in one case and sentenced to undergo life imprisonment and other cases are pending trial. Therefore the representation submitted by the petitioner was rightly
rejected by the second respondent and this Court finds no infirmity or illegality in the order passed by the second respondent.
3. The learned counsel appearing for the petitioner seeks one day emergency leave to perform the 16th death ceremony of mother of the petitioner.
4. Considering the submission that the convict has to perform the 16th day death ceremony of his mother , this Court is inclined to grant one day emergency leave with escort to convict.
5. Accordingly, the impugned order passed by the second respondent is set aside and writ petition is disposed of with the following directions:
(i) The respondents are directed to grant one day emergency leave with escort to the convict prisoner namely, Ravindran, (43 years) S/o.Subburaj, C.P.No. 6270, PID No.53453 on 10.02.2026. The convict prisoner shall be released from the prison on 10.02.2026 @6.00 a.m.,
(ii) He shall report back to the Superintendent of Prison, Central Jail, Madurai / second respondent, by 10.02.2026 at 5.00pm.., (iii) The escort charges shall be borne by the petitioner and if necessary, the same shall be adjusted from the income earned by the convict prisoner during the imprisonment period.
(iv) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities, (v) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
