O R D E R

The petitioner is working as a driver in the respondent Transport Corporation. A sum of Rs.4,115/- has been deducted by the respondent Corporation from his July 2024 month salary, without his consent. Aggrieved by that, the petitioner has submitted repeated representations and filed this writ petition seeking a Mandamus, to direct the respondent Corporation to consider his representation, dated 28.12.2025 and to pay him the entire salary. 2.Mr.S.C.Herold Singh, learned Standing Counsel takes notice for the respondents and submits that an order has been passed 2/6

by the Sub Court, Devakottai in EP No. 140 of 2019 in Arbitration Award No.35 of 2018 that the petitioner has stood as a guarantor in a chit fund transaction of Dhanalakshmi Srinivasan Chit Funds Pvt, Ltd., Karaikudi. The person, who has taken the loan amount has not repaid the the same to the Finance Company. Therefore, the Finance Company has filed an Execution Petition before the Sub Court, Devakottai. The Sub Court has allowed the Execution petition, by its order dated 24.07.2024 and awarded a sum of Rs.3,24,435/- together with interest. Since the petitioner stood as a guarantor, he was also added as a party to that proceedings and a portion of the amount was directed to be deducted from his salary, as per the order passed in EP No.140 of 2019 in ACP Award No.35 of 2018, dated 24.07.2024. Therefore, they are deducting a sum of Rs.

3965/- +Rs.150 towards the demand draft charges from the petitioner's salary, which has to be remitted to the credit of the Court concerned. A copy of the order passed in EP No.140 of 2019 in ACP Award No.35 of 2018, dated 24.07.2024 is placed before this Court.

3. Recording the aforesaid submissions made by the learned Standing Counsel for the transport Corporation, this writ petition is closed with liberty to this petitioner to pursue his case as against the order passed by the Sub Court, Devakottai, in accordance with law. No costs.
