PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order 2024/0103/13/328302TR dated 03.09.2024 passed by the third respondent and quash the same as illegal, arbitrary and consequently direct the respondent to issue the separate patta in favour of the petitioner for the said landed property comprised in survey No.448/3, 448/8, 446/2 and 449/1A situated at R.Pudukottai, Gujiliamparai Taluk, Dindigul District by considering the petitioner's representation dated 22.01.2025 For Petitioner : Mr.S.Harish For R1 to R4 : Mr.M.Lingadurai Special Government Pleader For R5 : No appearance For R6 : Expired

ORDER

I have heard Mr.S.Harish, learned counsel appearing for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents 1 to 4.

2. The petitioner challenges the order of the third respondent and consequently seeks issuance of separate patta in favour of the petitioner, by considering the petitioner's representation dated 22.01.2025. 2/5

3. On carefully analysing the arguments of the counsel on either side and on going through the order impugned in the writ petition, I find that no reasons have been assigned before passing the impugned order and petitioner has also not been given a fair opportunity to put forth her contentions.

4. On this limited ground, the impugned order deserves to be set aside and the writ petition is allowed. The matter is remitted to the third respondent for fresh consideration of the petitioner's application, on merits and in accordance with law after hearing the petitioner as well as the respondents 5 & 6 and pass final orders, within a period of twelve weeks from the date of receipt of a copy of this order.
