PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to dispose the case in C.C.No.160 of 2017 on the file of the learned Judicial Magistrate No.I, Thoothukudi For Petitioner : Mr.A.B.Jeeva For Respondents : Mr.R.Anandharaj No.1 Additional Public Prosecutor

ORDER

This petition has been filed seeking direction to dispose the case in C.C.No.160 of 2017 on the file of the learned Judicial Magistrate No.I, Thoothukudi.

2. The learned counsel for the petitioner would submit that the case was originally registered on 09.01.2017 and the respondent police after completing investigation filed final report before the concerned Court on 15.03.2017 and the case was taken on file in C.C.No.160 of 2017 and after receipt of summons the petitioner is regularly appearing before the Court and for the past three years there is no progress in the trial. Hence he has filed the present petition.

3. The learned Additional Public Prosecutor would submit that the post of Judicial Magistrate No.I, Thoothukudi is vacant and the learned Judicial Magistrate No.II, Thoothukudi is incharge of the Judicial Magistrate Court No.I, Thoothukudi.

4. Under such circumstances , there shall be a direction to the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD) No.3704 of 2020 learned Judicial Magistrate No.II, Thoothukudi to dispose the case pending in C.C.No.160 of 2017 within a period of six months from the date of receipt of a copy of this order.

5. With the above direction, the Criminal Original Petition is disposed of.
