PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to remove the encroachment by evicting the compound wall with grill gate illegally put up by the 4th respondent in Survey No.387 situated at Veerasigamani Village, Sankarankovil Taluk, Tenkasi District.

[Order of the Court was made by J.NISHA BANU, J.] By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

2.Today, when the matter is taken up for admission, Mr.J.Ashok, learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the compound wall with grill gate, which is sought to be removed by the petitioner, is situated in private patta land. 3.In view of the said submission, this Court is of the view that since the land in question is the private patta land, where the compound wall with grill gate

is situated and the dispute is private in nature, the petitioner has to approach only the competent civil Court seeking redressal of his grievance, if so advised.
