Petitioners 1 & 2 PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the case on the file of the Principal Sub Court, Madurai in A.S.No.59 of 2022 and transfer the same to be tried along with A.S.No.36 of 2018 on the file of the second Additional Sub Court, Madurai.

ORDER

The present transfer civil miscellaneous petition has been filed to transfer A.S.No.59 of 2022 on the file of the Principal Sub Court, Madurai to the file of the II Additional Sub Court, Madurai and to be tried along with A.S.No.36 of 2018 on the file of the II Additional Sub Court, Madurai.

2. The learned counsel for the second respondent submits that the second respondent has no objections for allowing the present transfer civil miscellaneous petition. However, he requests the Court to fix the time limit for disposal of both the appeals filed by the petitioner herein.

3. Recording the same, the present Transfer Civil Miscellaneous Petition stands allowed by transferring the A.S.No.59 of 2022 pending on the file of the Principal Sub Court, Madurai to II Additional Sub Court, Madurai and to be tried along with A.S.No.36 of 2018 filed by the petitioner herein on the file of the II Additional Sub Court, Madurai. The II Additional Sub Court, Madurai shall endeavour to dispose of both the appeals as expeditiously as possible preferably within a period of 6 2/4
