SIDE) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners are the accused Nos.1, 2 and 4 and apprehend arrest at the hands of the respondent Police in pursuance of non bailable warrant issued against them by the learned District Mahila Court, Karur in S.C.No.66 of 2012 dated 22.12.2015 for the offence under Sections 147, 148, 120(b), 364, 302 IPC r/w 149 IPC and hence, seek anticipatory bail.

2.It is submitted by the learned counsel for the petitioners that due to the death of the close relative of the petitioners, on 22.12.2015 the petitioners were unable to appear before the Court and hence, the learned District Mahila Judge, Karur has issued non bailable warrant.

3.The learned Government Advocate (Crl.side) submitted that the case is at the stage of argument.

4.Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, the Criminal Original Petition is dismissed. https://hcservices.ecourts.gov.in/hcservices/

However, this Court directs the petitioners to surrender before the Trial Court within a period of 3 days from the date of receipt of a copy of this order. On such surrender, the Trial Court is directed to consider the application of the petitioners on the same day purely on merits and in accordance with law.
