ORDER : The Court Made the following order :- The petitioners/Accused Nos.1 to 3, who were arrested and remanded to judicial custody on 02.11.2015 for the alleged offences punishable under Sections 3(a) of Railway Property (Unlawful Possession) Act 1966, Amended Act 2012, in Crime No.4 of 2015 on the file of the respondent police and hence, seek bail. 2.The case of the prosecution is that the petitioners have committed theft of Railway Parcel which containing 145 Nos of Ever Silver Pots worth about Rs.15,000/-. Therefore, the case has been registered for the above said offences.
3.The case of the petitioners is that they are innocent persons and they have not committed any offence as alleged by the prosecution and they are in judicial custody from 02.11.2015. 4.The learned Government Advocate (Crl.side) submitted that the petitioners are habitual offender and they have committed theft of Railway property and the properties have been recovered from the https://hcservices.ecourts.gov.in/hcservices/ accused.
5.Considering the facts and circumstances of the case and also considering the fact that the properties have been recovered from the accused and the petitioners are in judicial custody from 02.11.2015, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Karur and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further orders. sd/- 04/01/2016 / TRUE COPY / Sub-Assistant Registrar TO 1 THE JUDICIAL MAGISTRATE NO.I KARUR.
