ORDER : The Court Made the following order :- The petitioners, who are arrayed as A-1, A-2, A-10, A-13, A-15 and A16, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 341, 294(b), 323, 387, 506 (ii) I.P.C and Section 3(1) of TNPPDL Act, in Crime No.887 of 2015, on the file of the respondent police hence, seek anticipatory bail. 2.It is submitted by the learned counsel for the petitioners that the petitioners are innocent persons and they have not committed any offence and a false case has been foisted against them. 3.The learned Government Advocate (Crl.side) submits that the petitioner has caused damage to the decorated Christmas light, worth to the tune of Rs.25,000/-.
https://hcservices.ecourts.gov.in/hcservices/ 4.Considering the facts and circumstances of the case and also considering the nature of the offence, this Court is inclined to grant anticipatory bail to the petitioners with some certain conditions.
5. i) Accordingly, the petitioners altogether are directed to deposit a sum of Rs.25,000/- (Rupees twenty five thousand only) before the trial Court to the credit of Cr.No.887 of 2015;
ii) On such deposit, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Eraniel, and on each executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before respondent Police daily at 10.30 a.m. for a period of two weeks and thereafter as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 29/12/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
