ORDER

Challenging the order passed by the Judicial Magistrate, Oddanchatram in C.C.No.184 of 2012, dated 10.12.2018, this criminal revision case is filed.

2. C.C.No.184 of 2012 is pertaining to Negotiable Instruments Act. However, the impugned order came to be passed recording the continuous absence of the complainant despite pendency of bailable warrant for a long time. Recording the absence of the complainant, the complaint was dismissed for default.

3. This Court sets aside the impugned order, dated 10.12.2018 and directs the revision petitioner to pay a cost of Rs.5,000/- (Rupees Five Thousand only) to the respondent within a period of two (2) weeks from the date of receipt of copy of this order. The learned Trial Court is directed to take up the matter to the file and dispose of the same within a period of four (4) months from the date of receipt of copy of this order.
