O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus directing the respondents 1 to 3 to provide police protection to celebrate the festival of Arulmigu Karumalyansamy Temple situated at Muthuramalingapuram Village, Melakavanur Panchayat, Paramakudi Taluk, Ramanathapuram District which will be held on 18.02.2023 and 19.02.2023 as per the representation made by the petitioner dated 27.01.2023.

2. Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor takes notice for the respondents 1 to 3. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the writ petitioner submitted that the writ petitioner is the Poosari of Arulmigu Karumalyansamy Temple situated at Muthuramalingapuram Village, Melakavanur 2/6

Panchayat, Paramakudi Taluk, Ramanathapuram District, that the writ petitioner and the other members of the festival committee have decided to perform Sivarathiri festival on 18.02.2023 and 19.02.2023 in the said temple, that the fourth respondent unnecessarily create problems with an intention to stop the festival and that therefore, the writ petitioner has sent a representation dated 27.01.2023 to the respondents 1 to 3 for providing police protection to celebrate the festival. But, the respondents 1 to 3 have not considered the said representation. Since no order was passed, the writ petitioner has come before this Court for the above said relief.

At this juncture, the learned Additional Public Prosecutor appearing for the respondents 1 to 3 would submit that the fourth respondent, who was raising objections earlier, subsequently has given a letter stating that he has no objection to conduct the Sivarathiri festival by the writ petitioner. He would further submit that the representation of the writ petitioner is pending before the third respondent.

5. Recording the submission made by the learned Additional Public Prosecutor, the third respondent is directed to consider the 3/6

representation of the writ petitioner and pass orders tomorrow (16.02.2023).

6. With the above direction, this Writ Petition stands disposed of. No costs.
