This petition has been filed to withdraw the case on the file of the Learned Subordinate Judge, Avinashi, Tiruppur District in H.M.O.P.No. 04 of 2024 and transfer the same to the Learned Family Court, 1/4

Sriviliiputhur at Virudhunagar District.

2.The facts in brief:

The marriage was solemnized between the parties on 26.02.2018. Out of the wedlock they gave birth a female child. Thereafter the respondent gave torture to the petitioner. Due to which dispute arose between them. The respondent filed the above said H.M.O.P. proceedings before the Subordinate Court, Avinashi. Since the petitioner is facing difficulties to travel such long distance to attend every hearing before the Subordinate Court, Srivilliputhur. Hence, seeking transfer of the same, this petition has been filed. 3.Heard the learned counsel for the petitioner. Even though the respondent was served with notice, none appears on behalf of him. His name was also printed in the cause list.

4.Considering the facts and circumstances of the case and considering the convenience of the wife, the H.M.O.P.No.4 of 2024 filed by the respondent on the file of the Subordinate Court, Avinashi, 2/4

Tiruppur District, is ordered to be withdrawn and transferred to the Family Court, Virudhunagar at Srivilliputhur. 5.Accordingly, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. 25.03.2024 NCC :
