To set aside the Judgement and Decree made in O.S.No.122 of 2011 dated 07.08.2018 by the Learned Additional District & Sessions Judge,(Fast Track Court) Nagercoil, Kanyakumari District and allow this appeal.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.R.ANBARASU, Advocate for the petitioners, the court made the following order:- This petition is filed to condone the delay of 353 days in representing the above appeal.

2. The learned counsel for the petitioner submitted that because of the Covid-19 he could not get back the bundle in time and representing the above appeal.

3. The respondent did not file any objection.

CMP(MD) No.1736 of 2022 Accordingly, this petition is allowed on condition that the petitioner should deposit a sum of Rs.1,000/- as cost.

Accordingly, this petition is allowed on the condition to pay a sum of Rs.1,000/- (Rupees One Thousand only) to the credit of District Siddha Medical Officer CCRIPKM (Account No:-10767823177, IFSC Code:- SBIN0000898, State Bank of India, Periyakulam Branch) within a period of two weeks from today.
