Respondents (R3 is impleaded vide Court order dated 12.02.2018 in WMP(MD)No.2755 of 2018) Prayer : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 and 2 to appoint the petitioner as a Clerk or Sweeper in the second respondent's Municipality. The petitioner has completed 10th Standard and he is entitled to be appointed as a Clerk in the second respondent's Municipality on compassionate ground within a time frame.

2.The petitioner's father was working as a Sweeper in the second respondent Municipality. He died on 08.07.2016 while in service. The petitioner therefore applied for appointment as Clerk on compassionate grounds. The second respondent forwarded the petitioner's application to the third respondent. The application was returned for answering certain queries. The same has been duly complied with and the application has been resubmitted for consideration by the third respondent on 03.11.2016. 3.The third respondent is directed to consider the application for compassionate appointment based on merits and in accordance with law. The third respondent shall pass orders in this regard on or before 30.04.2018.
