Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 420 I.P.C., in Crime No.1027 of 2015, on the file of the respondent police hence, seeks anticipatory bail. 2.It is submitted by the learned counsel for the petitioner that the petitioner is an innocent person and he has not committed any offence and a false case has been foisted against him.
3. The case of the prosecution is that this petitioner has received a sum of Rs.9,50,000/- from the defacto complainant and one another, on the assurance that he would secure a job in the Electricity Board to the defacto complainant and subsequently, cheated them.
4. The learned counsel for the petitioner on instructions submits that the petitioner is ready to deposit the said amount. 5.The learned Government Advocate (Crl.side) submits that investigation is going on.
6. Considering the facts and circumstances of the case and also considering the undertaking made by the learned counsel for the petitioner, this Court is inclined to grant anticipatory bail to the https://hcservices.ecourts.gov.in/hcservices/ petitioner with some stringent conditions.
7. (i) Accordingly, the petitioner is directed to deposit a sum of Rs.9,50,000/- (Rupees nine laks fifty thousand only) before the trial court to the credit of Cr.No.1027 of 2015;
(ii) On such deposit, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, No.III, Trichy, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for a period of two weeks and thereafter as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
8. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
