PRAYER: Civil Miscellaneous Petition is filed under Section 55 of Civil Procedure Code, to set aside the fair and decreetal order, dated 28.11.2019 passed in I.D.O.P.No.6 of 2015 on the file of the Principal Sessions Judge, Theni and to grant divorce as the relief sought for by the appellant in the said petition by allowing the present Civil Miscellaneous Appeal.

ORDER

This Civil Miscellaneous Appeal has been filed to set aside the fair and decreetal order, dated 28.11.2019 passed in I.D.O.P.No.6 of 2015 on the file of the Principal Sessions Judge, Theni. 2.The appellant as well as the respondent are present before this Court and they are identified by the respective learned counsel and both the parties have filed a joint compromise memo stating both the parties agreed for the terms of compromise and one time settlement amount also paid to the respondent/wife. The said compromise memo is recorded.

3.This Civil Miscellaneous Appeal is allowed as per the terms of compromise memo. The Compromise memo shall form part of the order. No costs.
