BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT ( Criminal Jurisdiction ) Friday, the Thirteenth day of February Two Thousand Fifteen PRESENT THE HON`BLE MR JUSTICE P.N.PRAKASH CRL OP(MD) No.2500 of 2015 1 M. MAHESHKUMAR @ KUMAR 2 S. RAMASAMY @ BALAN ... PETITIONER/ACCUSED NO.2 & 3 Vs THE INSPECTOR OF POLICE ARAVAKURICHI POLICE STATION, KARUR DISTRICT.

CRIME NO.64/2015 ... RESPONDENT/COMPLAINANT For Petitioner : M/S.M. MAHARAJA Advocate For Respondent : MR.P.KANNITHEVAN, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 294(b), 323 and 366 of Indian Penal Code in Crime No.64 of 2015 on the file of the respondent police, seek anticipatory bail.

2. It is the case of the prosecution that the victim girl, by name Geetha is aged about 25 years and working as a teacher in a private School. Her father would drop her every day in the School in his vehicle. On 09.02.2015 when her father was taking her in his vehicle to drop her in the School, a Maruthi Omni Van without number plate, intercepted them, from there, three persons got down and after assaulting her father, Geetha was abducted by them. It is seen that the abduction was masterminded by Balakrishnan, the first accused in this case, who wanted to marry Geetha, which was not accepted by Geetha's parents.

3. Now, it is represented by the police that the victim girl Geetha has come back to her house only on 11.02.2015 and her statement under Section 164 of the Code of Criminal Procedure is to be recorded.

4. Taking into consideration the gravity of the allegations against these petitioners and the manner in which the abduction has been done, I am of the view that this is not a fit case to grant anticipatory bail to the petitioners and hence, the petition seeking anticipatory bail stands dismissed.
