PRAYER :- For Bail in Crime No.13/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner /A1 who was arrested and remanded to judicial custody on 21.01.2023 for the offences under sections 294(b),307 and 506(ii) of IPC in Crime No.13 of 2023 on the file of the respondent police seeks bail.

2. The case of the prosecution is that due to previous enmity the petitioner along with other accused abused the defacto complainant in filthy language assaulted him and also threatened with dire consequences, hence the case.

CRL OP(MD). No.2980 of 2023 submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner is in judicial custody from 21.01.2023, hence he seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that due to previous enmity the petitioner along with other accused abused the defacto complainant in filthy language assaulted him and also threatened with dire consequences, hence he objected to grant bail to the petitioner. He would further submit that injured has been discharged from the hospital and the petitioner is having ten previous cases.

5. Heard. Perused the materials available on record including the First Information Report.

6. Taking into consideration of the facts and circumstances of the case and also taking note of the fact that ten previous cases are pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
