ORDER

This Criminal Original Petition is filed to direct the learned Special Courts for SC/ST, Ramanathapuram to consider and dispose of the Bail Application filed by the Petitioner in Crime No.14 of 2026 dated 28.01.2026 on the file of the second Respondent herein on the same day of his surrender before the said Court.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. Gist of the case: The third respondent has given a complaint as against the petitioner herein. The third respondent / de-facto complainant is working as a driver in a School at Paramakudi. On 27.01.2026, when the third respondent along with another person were driving the school vehicle, stopped the vehicle near a petrol bunk, for letting the children alight, the petitioner who was working in the said petrol bunk, questioned the third respondent for stopping the vehicle at that place. He has also abused the third respondent with filthy, derogatory caste based words, assaulted him and threatened him with 2/5

dire consequences. In this incident, the third respondent sustained injuries and admitted to the Government Medical College Hospital, Ramanathapuram. Hence a complaint has been given and a case in Crime No.14 of 2026 has been registered for the offences under Sections 296(b), 115(2), 351(2) of BNS, 2023 (Corresponding to under Section 294(b), 323, 506(i) of IPC) and Section 3(1)(r), 3(1)(s) of SC/ST (POA) Act, 2015.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby directs the learned Special Courts for SC/ST, Ramanathapuram, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.14 of 2026 on the file of the 2nd respondent police. The petitioner shall surrender before the learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
