Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.C.SURESH KANNAN, Advocate for the petitioner and of MR.M.V.CHANDRASEKARAN, Government Advocate(Crl.side) on behalf of the Respondent, the court made the following order:- This petition is filed to extend the time limit of the petitioners to comply the order passed in Crl.O.P.(MD).No.747 of 2021, dated 21.01.2021.
2.The learned counsel appearing for the petitioners submitted that the petitioners were granted anticipatory bail by this Court in Crl.O.P.(MD).No.747 of 2021 and one of the condition is that the petitioner shall draw a demand draft in favour of Dean, Government Rajaji Hospital, Madurai, for a sum of Rs.7,500/- each within a period of fifteen days from the date of receipt of a copy of that order before the learned Judicial Magistrate, Manamadurai. He further submitted that they had taken a Demand Draft in favour of the Rajaji Government Hospital, Madurai. He further submitted that the petitioner was unable to execute the sureties, since the 1/3
respondent Police has come under the jurisdiction of the Judicial Magistrate, Thiruppuvanam. Hence, he seeks modification. 3.Heard the learned counsel for the petitioners and the learned Government Advocate(Crl.Side) for the respondent. 4.Considering the reasons stated in the petition, the condition imposed by this court in Crl.O.P.(MD).No.747 of 2021, dated 21.01.2021 is modified to the effect that the petitioners shall execute a bond for a sum of Rs.10,000/- each with two sureties each for the like sum to the satisfaction of the learned Judicial Magistrate, Thiruppuvanam and time for surrender by the petitioners before the concerned Court and executing the sureties is extended by two weeks from the date of receipt of a copy of this order, failing which the anticipatory bail already granted by this Court shall stand cancelled.
It is made clear that no further extension will be granted and if the petitioners fail to comply with the order within the stipulated period, the respondent police shall secure the petitioners and proceed in accordance with law. 5.Accordingly, this Criminal Miscellaneous Petition is allowed. sd/- 08/03/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
