ORDER
The present writ petition has been filed to quash the order, dated 04.02.2025 passed by the third respondent in Na.Ka.No. 01/I.P/V.V/Karur/2025 and consequently direct the respondents to grant permission to conduct "Horse Race" in view of the celebration of 77th Birthday of Late. Selvi J.Jeyalalitha on 23.02.2025 in Karur to Vangal Road at Arasucolony Minnampalli Pirivu to Vangal with in a time frame fixed by this Court.

2. According to the petitioner, the petitioner is the active member of All India Anna Dravida Munnetra Kazhagam, Karur District, Youth Wing Secretary. The AIADMK's erstwhile General Secretary and former Chief Minister of Tamil Nadu Late Selvi J.Jeyalalitha birthday would be celebrated on 24.02.2025 of every year. Therefore, the petitioner wanted to conduct "Horse Race" on 23.03.2025 in Karur to Vangal Road at Arasucolony Minnampalli Pirivu to Vangal. Hence, the petitioner sent a representation, dated 23.01.2025 to the respondents seeking permission to conduct "Horse Race" but the third respondent rejected through an order, dated 04.02.2025 in Na.Ka.No.01/I.P/V.V/Karur/2025. The reasons assigned by the respondents are not acceptable.
The only main reason was on the same day already permission was granted to some other person, therefore, there will be a chance for law and order issue. However, now the petitioner want to conduct "Horse Race" on 16.03.2025 and they also assure not to create law and order issue and if any condition imposed by the respondents, they will abide. Therefore, the petitioner prays for permission to conduct "Horse Race".
3. The learned Government Advocate (Crl. Side) appearing for the respondents would submit that they already received the request of the petitioner, dated 23.01.2025 and the same was rejected through an order, dated 04.02.2025 by citing various reasons.

At this juncture, the learned Counsel appearing for the petitioner would submit that already they permitted to conduct "Horse Race" to the ruling party persons through an order, dated 12.03.2025 but rejected the petitioner only on the ground that the petitioner belongs to opposite political party. Further, after receipt of rejection order, the petitioner again submitted another petition to conduct race on 16.03.2025 and the same is pending with the respondents 3 and 4.
5. After elaborate arguments, the learned Government Advocate (Crl. Side) appearing for the respondents would submit that if the petitioner undertakes to conduct "Horse Race" by following all the procedures, they will permit them by imposing some conditions. 4/7
6. Since the representation for conducting "Horse Race" on 16.03.2025 is pending with the third respondent for consideration, this Court directs the third respondent to consider the representation of the petitioner, positively by imposing appropriate conditions in accordance with law.
