Order: This petition coming on for hearing on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.C.MAYILVAHANA RAJENDRAN, Additional Public Prosecutor appearing for the petitioner, the court made the following order:- (order of the Court was made by K.K.SASIDHARAN,J.) This Petition is to recall the order dated 28.06.2016, whereby and whereunder, we directed the Inspector of Police, Town Police Station, Thirumangalam, Madurai District, to pay a sum of Rs.5,000/- towards cost, on account of his failure to file a status report.

2. The Inspector of Police, in his affidavit filed in support of the https://hcservices.ecourts.gov.in/hcservices/ application in Crl.M.P(MD)No. 5433 of 2016, submitted that failure to file status report was not wilful.

3. We have perused the status report also.

4. In view of the background facts and taking into account the reasons given by the Inspector of Police, we are of the view that the order dated 28.06.2016, directing payment of cost requires to be recalled.

5. In the result, the order dated 28.06.2016, with respect to payment of costs is recalled.

6. The application is allowed accordingly.
