Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to remove encroachment made by the 8th respondent and restore the water channel runs west side on the survey No.126/1 at Maravayikudi Village, Pooseri Post, Kadaladi Taluk, Ramanathapuram District and consequently directing the respondents not to make water channel in the petitioner's patta land survey Nos.124/1E2A, 124/1F1 and 124/1G1 by considering her representations dated 20.02.2024 and 28.11.2024 within a time frame that may be fixed by this Court.

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the official respondent.

2. The only apprehension of the petitioner is that through his patta land, a new channel may be created. The learned Additional Government Pleader on instructions states that the petitioner need not have any cause for apprehension. On the other hand, it is submitted that it was the petitioner who had obstructed the free flow of water through channel in survey No.339/7 and the obstruction was removed after the villagers complained against the petitioner. The petitioner has come up with counter allegations that the eighth respondent Abdulsalam has obstructed free flow of water in survey No.126/1. It is asserted by the official respondents that Abdulsalam has not made any such obstruction.
3. Recording the said stand of the official respondents, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
