O R D E R
This writ petition has been filed for a Writ of Mandamus directing the second respondent to consider the representation to review the suspension order passed in Na.Ka.No.A55941/2023 dated 30.11.2023 and to revoke the suspension order by considering the representation dated 07.01.2025.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and perused the records.
3. The case of the petitioner is that while he was working as Field Surveyor, a criminal case was registered against him by the Vigilance and Anticorruption Department on 29.11.2023. Pursuant to registration of criminal case, the petitioner was kept under suspension on 30.11.2023 by the second respondent. Requesting to revoke the suspension order, the petitioner submitted a representation on 07.01.2025. Against the inaction of the respondents in considering the same, the present writ petition is filed.
4. The learned counsel for the petitioner submits that though it was 2/6
mentioned in the suspension order that the petitioner is entitled for subsistence allowance, the respondents did not pay subsistence allowance to the petitioner. The learned counsel for the petitioner would further submit that the suspension order has to be viewed once in three months by the respondents, but, it is not reviewed.
5. On the other hand, the learned Additional Government Pleader would submit that the representation dated 07.01.2025 submitted by the petitioner will be considered in accordance with law within a time to be stipulated by this Court.

Considering the facts and circumstances of the case, this Court is of the considered opinion that this writ petition can be disposed of at the stage of admission with consent of both sides without going into the merits of the case, instead of keeping it pending for years together with a direction to the second respondent to consider the representation dated 07.01.2025 of the petitioner within a stipulated time in accordance with law and taking into consideration the instructions issued in G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022 to meet the ends of justice. 3/6
7. Accordingly, this writ petition is disposed of with the following direction:
''The second respondent is directed to consider the representation dated 07.01.2025 of the petitioner and pass appropriate orders taking into consideration the instructions issued in G.O.Ms.No.81,Human Resources Management(N)Department dated 04.08.2022 and by following due process of law within a period of four weeks from the date o receipt of a copy of this order''.
There shall be no order as to costs.
