ORDER
This Criminal Original Petition has been filed by the petitioner to 1/4
quash the F.I.R in Crime No.327 of 2022 on the file of the first respondent police.
2. Today, when the matter is taken up for hearing, the learned Government Advocate (Criminal) appearing for the first respondent would submit that already they have completed the investigation and filed the final report on 16.07.2022 before the Judicial Magistrate, Oddanchatram. Therefore, nothing survives for further adjudication.
3. In this case, the petitioner has challenged the pending F.I.R in Crime No.327 of 2022, but the investigating agency after an elaborate investigation, they have filed the final report.
4. Since the prayer of the petitioner is to quash the F.I.R, even as per the F.I.R, there are some allegations to constitute the offences and the first respondent have filed the final report after an elaborate investigation, it is appropriate to dispose the petition by preserving the liberty of the petitioner to challenged the final report, if it is against him. However, the charge sheet has been filed in the year 2022 itself, therefore it is for the learned Magistrate to take appropriate steps on the final report filed by the respondent police in accordance with law.
