O R D E R

This Writ Petition has been filed seeking a writ of mandamus directing the first respondent to consider the petitioner's representation dated 08.09.2023, within a period that may be stipulated by this Court.

2. Heard the learned counsel for the petitioner, learned Additional Government Pleader for the respondents 1 and 2 and the learned counsel for the third respondent.

3. The petitioner joined duty in the water supplies division in the year 1995 as Electrician Grade II. At present, he is working as Technical Assistant. He has some grievance with the respondents about preparing the seniority list. Being the most affected person, the petitioner submitted a representation on 08.09.2023 to the first respondent through proper channel seeking to place in the post of Junior Engineer instead of Technical Assistant as per G.O.237 2/5

MA&WS Department, dated 26.09.1996. Against the inaction of the respondents in considering the petitioner's representation, he filed the present writ petition.

4. The learned counsel for the petitioner would submit that the petitioner is the most affected monetarily by having been in the lower scale of pay and denied promotion by adverse placement of classification.

5. The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that as the representation is submitted on 08.09.2023, normally, it will be considered and disposed of within a time to be stipulated by this Court.

Considering the submissions of the respective learned counsels, in our considered view, it is appropriate and reasonable to dispose of this writ petition at the admission stage with the consent of both parties without going into the merits of the case with a direction to the first respondent to consider the representation, dated 08.09.2023 submitted by the petitioner in accordance with law and pass appropriate orders within a stipulated time to meet the ends of justice.

Accordingly, this writ petition is disposed of with a direction to consider and pass appropriate orders on the representation, dated 08.09.2023 submitted by the petitioner in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
