ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 420 of Indian Penal Code in Crime No.Not Known of 2015, on the file of the Inspector of Police, Anti Land Grabbing Cell, Sivagangai, seeks anticipatory bail.

2. The respondent in this court is the Inspector of Police, Anti Land Grabbing Cell, Sivagangai.

The first Bench of this Court in W.P.Nos.18872 of 2011, batch, by order dated 10.02.2015, has quashed the G.O.(Ms)No.423, Home (Pol-XI) Department, dated 28.07.2011, by virtue of which Anti Land Grabbing Special Cell was constituted by the State of Tamil Nadu in various Districts. On account of the order passed by the first Bench, the police are in a limbo and they do not know whether to proceed with the investigation or transfer the case to the regular units. The State has also filed a Special Leave Petition before the Supreme Court.

3. Under such circumstances, this Criminal Original Petition is closed with liberty to the petitioner to move this Court afresh, if he apprehends arrest pursuant to the complaint given by One Bethayee by any other Unit of the Police Department.
