PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to consider the application given by the petitioner for regularization of his unapproved plots No.5 and 6 situated in Nelmudikarai Village,Thirupuvanam Taluk, Sivagangai District consequently directing the 1st respondent to give Building Permission and Plan approval.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to consider the application of the writ petitioner for regularisation of his unapproved Plot Nos.5 and 6 situated at Nelmudikarai Village, Thirupuvanam Taluk, Sivagangai District and consequently direct the first respondent to give building plan permission and plan approval.

2. A perusal of the records reveal that the petitioner has purchased two plots in an unapproved layout. The petitioner has made an application to the first respondent for regularisation of his plots.

3. The learned Additional Government Pleader appearing for the first respondent brought to the notice of the Court that the first respondent is not the competent authority to consider the request of the petitioner. The petitioner has to approach only the Director of Town and Country Planning with an application for regularisation of the plots as contemplated under the Tamil Nadu Regularisation of Unapproved Plots and Layouts Rules, 2017. 2/4

4. In view of the above said facts, the petitioner is directed to approach the concerned authority under the above said rules seeking regularisation of his plots. In case if regularisation is granted, the first respondent could proceed to consider the request of the petitioner for grant of building plan approval.

5. With the above said observations, this writ petition stands disposed of. No costs.
